Terms & Conditions

By commissioning a portrait or buying other items from the artist, such as prints, the client is agreeing to the following Terms and Conditions.

Copyright

​

I, the artist, retain full copyright of all artwork produced, including any sketches involved in producing the finished portrait. This is so I can use the image of the artwork on my social media pages for promotional purposes and on my website. I also retain copyright of all the text written on my website. I may post client's emails, or parts thereof, as testimonials on my website. If a client does not wish me to use the image of their portrait or part or all of their emails then I ask that they notify me of this when they commission their portrait. I will not reproduce a client's portrait for prints or for use on merchandise as I understand how personal a client's portrait is to them. Nor will I allow anyone else to buy the copyright of a client's portrait.

Lead time

​

I have a client waiting list that can differ in length depending on time of year (for example, Christmas is a very busy time for me) and how many portraits I have booked in at any given time. When a client makes an enquiry or commissions a portrait I will give you an estimate of when your portrait will be completed by. This will only be an estimate and cannot be guaranteed. However, if you have a date by which you require your portrait, for example a birthday or wedding anniversary, please make me aware of this and I will do my best to accommodate your requirements.

Payment

I ask for a deposit of 25% of the total cost of the portrait when a client commissions their portrait and I book them in to my commissions diary. If a client wishes to cancel their portrait commission within 14 days of booking it they may do so and I will refund them their deposit. If they wish to cancel their commission after 14 days of booking it then the deposit will be nonrefundable to cover any preparations I have made for their portrait, such as sketches. I accept payment by cheque and bank transfer and I will send the client an invoice for the required amount. The balance of payment is due before I commence work on the client's portrait. I will send an invoice for the balance of payment 10 days before I am ready to start on the client's portrait. Once full payment has been made and I have commenced work on the client's portrait the client is committed to their portrait and the total cost of the portrait is non-refundable. When a client places a deposit or balance of payment (including by instalment) I will provide the client with my bank details for a bank transfer to be made (unless the client is paying by cheque). I would respectfully ask that the client deletes my bank details once the transaction has been completed.

I offer payment by instalments once the deposit has been made and require the final instament to have been paid before I commence work on the client's portrait.

Completion of the portrait

​

When I have completed the portrait I will email the client a photo of their portrait for approval. If the client requires any changes to be made to the portrait this is the time to let me know by email or phone. If any changes are required I will work with the client until they are happy with the portrait. If I am not able to sort out the issue to the client's satisfaction I will refund the full cost of the portrait. To date this has not been necessary. A client's happiness with their portrait is extremely important to me.

Shipping and Damage in transit

​

I pack client's portraits very safely and securely, and they are shipped with a tracking number . The client may have their portrait shipped to themselves or, if it is a gift, I can ship it directly to the person it is a gift for. In the unlikely event that a portrait is damaged in transit I will require the client to email me straight away with a photo of the damaged portrait and packaging. I will require the client to return the damaged portrait and the original packaging to me at the client's expense and I will create a new portrait for the client at no extra cost. The new portrait will be added to my waiting list and the client will be notified of the new lead time. Shipping costs within the UK and overseas are paid for by myself, with the exception of any Import Duty or Taxes, or anything more than the actual cost of shipping.

Prints

​

For any prints requested from the client's own portrait, or from artworks for sale in my Etsy shop, accuracy of reproduction of colour and likeness to the original cannot be 100% guaranteed, although every care will be taken to ensure they are as close a likeness to the original as possible.

Gift vouchers

​

I offer gift vouchers to purchase and these can be redeemed up to 24 months from date of purchase. They can be redeemed against commissioning a portrait or any items I offer for sale in my Etsy shop. Gift vouchers cannot be refunded or exchanged for cash.

Currency exchange

​

I reside in the UK and all prices quoted are in GBP The client's bank will exchange the client's payments to their own currency at their own exchange rate if the client is commissioning me from overseas. If a refund is required it will be in GBP and the exchange rate may differ from the exchange rate when you made the payment. I have no control over the exchange rate unfortunately.

 

Import duty

​

All items for sale, including portrait commissions, may be liable to the payment of Import Duty in some countries and this is the sole responsibility of the client.
